Knowing How Bail Bonds Work
Bail bonds work because if they did not, people will stay in jail indefinitely without any chance of preparation for their court hearing. For people who have never had the experience of being arrested (and one hopes that you never will), the process begins with a booking at the local jail and then incarceration until such time that the defendant gets to be in front of a judge for the details of the case.
Although in some states, the period between incarceration and the actual court hearing could take as little as 24 hours, realistically, the time could be indefinite. Bail bonds work in getting defendants out temporarily at the soonest possible time based of course on the circumstances of the offense. There are some offenses however, because of their gravity that the bail bond system does not apply. But if you have been arrested and booked, the first thing you should know is if it is a bailable offense and to know how to make bail bonds work to getting you out.
Bail bonds work under several categories, usually depending on a defendant's financial capacity and in some cases, on the circumstances of the offense. If you have sufficient cash to cover your bail bond, then by all means pay the full amount. But you have to remember that in some instances, you can only get your bail bond back after your case has been resolved and this could take anywhere from a wee to well over a year. If you need the money, cashing out is not the option for you. Bail bonds work under the assumption that it is almost always a safer bet to find other funding sources to pay for your bail bond.
This is where the bail bond agencies come in. A bail bond agency provides the full amount needed for bail. In return, a defendant would only have to pay the bail bond agency a certain percentage of the bail bond amount which is legally set at 10%. It is the bail bond agency who will guarantee through the bond, a defendant's return to have his day in court. This arrangement somehow works because it is actually on the best interest, legally and financially of the defendant to return and face the charges made against him or her. Bail bonds work on the principle and constitutional right that people have a right to seek temporary freedom before their case is heard in court. Bail bonds work also from an economic and marketing perspective. For agencies, this is a legal means of livelihood as well as providing for financial services to people who may not have the resources to pay bail bonds in the thousands or hundreds of thousands of dollars. Bail bonds work because there are also guarantees with regards to the money that the agency had put up as a bond. When defendants skip bail which they often do, bail bond agencies are legally allowed to look for them especially in cases when defendants with serious crimes were able to post bail and have skipped it. Bail bond agencies can employ in-house or outsourced bail bond enforcement agents who will track down and apprehend defendants who have skipped bail and have serious charges filed against them.
